Terms and Conditions of
Pierre Jean-Baptiste Interiors, Ltd.

E-COMMERCE / ONLINE SHOPPING
Client shall inspect all merchandise upon delivery and advise the freight company of any damage or non-conformity at that time. The client should not accept any merchandise that has damaged packaging unless it is opened and inspected at the time of delivery. For undamaged/unopened deliveries, the client will have 24 hours to inspect merchandise. Should merchandise be delivered damaged, the client will call Pierre Jean-Baptiste Interiors, Ltd. and email Pierre Jean-Baptiste Interiors a picture of the damaged merchandise. Pierre Jean-Baptiste Interiors, Ltd. will order a replacement for the damaged merchandise. Pierre Jean-Baptiste Interiors, Ltd. reserves the right to fix or replace damaged piece at no additional cost to the client. In either case, the client will not be responsible to pay any additional freight costs. Should the client return any merchandise or void this agreement after purchases has been made for reasons other than damage, the client will receive an 65% refund of the client Price. A restocking fee equal to 35% of the client price is required plus the cost of freight / un-assembly to return the item to the vendor. All returns must occur in the original packaging, and all merchandise must be unused and undamaged. All returns must be made within 14 days of delivery. All sales of custom merchandise are final and non-refundable. Refunds are usually issued by US postal mail within 30 Calendar days of approval. A signed invoice must be received before purchases are made. All prices listed on pierreji.com are correct at the time of entering the information, however, Pierre Jean-Baptiste Interiors, Ltd. reserves the right to change prices of any product at any time. No contract for the sale of any product will exist between you and Pierre Jean-Baptiste Interiors, Ltd. until we accept your order by sending you a confirmation email following your payment. You must check all the details on this confirmation email are correct and contact us as soon as possible, and if any details are incorrect or if your order has not been accepted, you will receive an email from us with an explanation.

OWNERSHIP OF DESIGNS
All concepts, drawings, and specifications prepared by Pierre Jean-Baptiste Interiors, Ltd. (a.k.a. Project Documents) and all copyrights and other proprietary rights applicable thereto remain at all times Pierre Jean-Baptiste Interiors, Ltd. property. Project Documents may not be used by client for any purpose other than completion of Project by Pierre Jean-Baptiste Interiors, Ltd.

BACK ORDERS
Factories make a certain number of items on a schedule. An item may be out of stock and on back order. Generally, the factory will give us an expected ship date. There is no guarantee that the date will be accurate. Please refer to our updates and we will keep you informed.

DISCONTINUED ITEMS
There will be times when a selected item is no longer available. While it is a disappointment and an inconvenience, we will notify you and possibly find acceptable replacements and solutions if applicable.

PAYMENT
Pierre Jean-Baptiste Interiors, Ltd. accepts payments via our e-commerce site. All credit and debit cardholders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to us, we will not be liable for any delay or non-delivery.

ORDER CANCELLATION
If you have placed an order with Pierre Jean-Baptiste Interiors, Ltd. but then wish to change or cancel it, please contact Pierre Jean-Baptiste Interiors, Ltd. immediately. Pierre Jean-Baptiste Interiors, Ltd. will try their best to make any changes but they cannot guarantee that they will be able to do so, as your interior design order may already have commenced or be completed.
To cancel an order you must inform us within 24 hours after your payment via email. Once Pierre Jean-Baptiste Interiors, Ltd. has received your cancellation email and confirmed that you wish to cancel an order by return email. Any sum debited to us from your credit or debit card will be credited to that credit or debit account within 30 days of your order.

DELIVERY
Most online purchases will aim to be delivered within 7 to 28 days of receiving payment. Pierre Jean-Baptiste Interiors, Ltd.’ Due to the current and past pandemic, we as most resellers may experience occasional delays. Should this be the case we will notify you.

PRIVACY POLICY
Pierre Jean-Baptiste Interiors, Ltd. will not pass on your personal, credit or debit card details to any third party without your permission.

LIABILITY
Pierre Jean-Baptiste Interiors, Ltd. does not accept liability for any errors and/or omissions contained in our website and reserve the right to change information, prices, specifications and descriptions of listed products and services at any time and without notice. If an error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible. We shall be under no obligation to fulfill an order for a product that was advertised at an incorrect price.
Pierre Jean-Baptiste Interiors, Ltd. has taken every measure to prevent Internet fraud and ensure any data collected from you is stored as securely and safely as possible. However, Pierre Jean-Baptiste Interiors, Ltd. cannot be held liable in the extremely unlikely event of a breach in secure computer servers.
Pierre Jean-Baptiste Interiors, Ltd. shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts of God, war, flood, fire, labor disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.
Pierre Jean-Baptiste Interiors, Ltd. offers no warranty that the website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the website. Pierre Jean-Baptiste Interiors, Ltd. will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.
To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the services and products. This does not affect your statutory rights as a consumer, nor does it affect your Contract Cancellation Rights.
Pierre Jean-Baptiste Interiors, Ltd. will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the conditions for:
• Any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings)
• Any loss of goodwill or reputation
• Any special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under the Terms and Conditions.
• Nothing in the Terms and Conditions shall exclude or limit our liability for death or personal injury resulting from negligence or that of our agents or employees.

Any controversy or claim arising out of or relating to this Agreement, or breach thereof, shall be decided by litigation in the Circuit Court of Fairfax County Virginia. The laws of the State of Virginia shall govern this Agreement. In the event Pierre Jean-Baptiste Interiors, Ltd hires counsel to enforce any right under this Agreement, client shall reimburse Pierre Jean-Baptiste Interiors, Ltd for all such attorney fees and expenses, regardless of whether or not a suit is filed.
